Future Leaders Terms and Conditions

OVERVIEW

The Home Health Care News Future Leaders Awards (“Awards”) takes place between May 15, 2019 and September 18, 2019. The Awards starts with a nomination process in which individuals or corporations will nominate a future leader for consideration as part of the program. A group of independent judges will evaluate each entry in its respective category and provide a score based upon the entry material and the judging criteria.

ELIGIBILITY

Nominees must be employed by a non-profit, for-profit or governmental agency and in the home health, private duty, hospice, palliative care or pediatric home health industries and the businesses that support them. Each award entry fee must be paid prior to the entry deadline in order to be considered for eligibility for consideration and judging. Entry fees are non-refundable. All nominees must be aged 18 years or over.

NOMINATION PROCESS

Individuals, a corporation or governmental may nominate someone for the awards program via the online submission starting May 15, 2019  and complete the process prior to 5 PM Central Standard Time on July 31, 2019 for consideration. Upon submission, each individual will be entered into the Awards. The form shall include the nominees name, organization, title, email address and information on their work for recognition based upon the program criteria.

Each nominee, if not self-nominated, accepts these terms and conditions upon accepting the nomination hereby agrees to the terms and conditions of the Awards. By entering the Awards, entrants and nominees agree to consent to HHCN using the personal information for the purposes of evaluating and judging as part of the competition.

Failure to claim or accept the nomination or meeting the eligibility criteria may result in disqualification or forfeiture of the prize.

JUDGING

All submissions will be scored by the judges on a ranking system for each of the categories and all entries will be tabulated and aggregated. The 3 highest scores will be recognized as finalists for each category announced on September 3, 2019. If a tied is scored at any point in the competition, an editor from Aging Media will act as an additional judge to evaluate and determine the winner. The final winners for each category will be announced at the HHCN Summit on September 18th

FINALISTS AND WINNERS

The top 3 finalists as scored by the judges will be announced on September 3, 2019. The winner for each category will be announced on September 18, 2019 at the HHCN Summit. Individual winners are responsible for expenses and arrangements for travel and accommodation should they wish to attend the HHCN Summit.

CANCELATION OR TERMINATION OF AWARDS

HHCN reserves the right to cancel, suspend and/or modify the Awards, or any part of it, if any fraud, technical failures, virus, human error, tampering or any other factor impairs the integrity or proper functioning of the Awards, as determined by HHCN in its sole discretion. In such event, HHCN reserves the right to award the prizes from among the eligible entries or plays received up to the time of the impairment. HHCN reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the or to be acting in violation of the Awards terms and conditions of this or any other promotion or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Awards may be a violation of criminal and civil law, and, should such an attempt be made, HHCN reserves the right to seek damages from any such person to the fullest extent permitted by law. HHCN’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

LIMITATION OF LIABILITY

HHCN is not responsible for interrupted or unavailable network server or other connections; for errors in communication protocols; failed telephone, computer or electronic transmissions; for jumbled, scrambled or misdirected entries or transmissions; for phone, electrical, network, technology or computer hardware or software or program malfunctions, failures or difficulties; or any other errors, omissions, interruptions, or deletions of any kind, whether human, mechanical or electronic; or for non-receipt of any entry regardless of the cause of it not being properly received.

HHCN is not responsible for unintelligible, late, lost or stolen entries; for incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the Awards; or for any technical, printing or human errors which may occur in the receipt, non-receipt or processing of any entries in the Awards.

HHCN MAKES NO WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE.  SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OF EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES. CHECK YOUR LOCAL LAWS TO LEARN IF ANY OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU.

PRIVACY POLICY

Any personally identifiable information collected during an applicant’s participation in the Awards will be collected by HHCN and used by HHCN in accordance with HHCN’s Privacy Policy as such is stated at https://homehealthcarenews.com/privacy-policy/. HHCN will share the nominators’ name with the nominee but not with the judges nor with the general public. Beyond the usage described in these terms and conditions, the information provided will be collected, stored and used in accordance with HHCN’s privacy policy

PUBLICITY RIGHTS

By submitting nomination, nominees (or persons entering on behalf of nominee) shall allow HHCN and/or HHCN’s designees the perpetual right to use his/her entry, name, biographical information, photos, videos and/or likeness, and statements for promotion, trade, commercial, advertising and publicity purposes, at any time or times, in all media now known or hereafter discovered, worldwide, including but not limited to on the World Wide Web and Internet, without notice, review or approval and without additional compensation except where prohibited by law. A signed affidavit of eligibility, publicity release and release of liability may be required.

GOVERNING LAW

Issues concerning the construction, validity, interpretation and enforceability of these Official Rules shall be governed by the laws of Illinois.

RELEASE

By participating, each nominee releases and agrees to indemnify and hold harmless HHCN & Others from and against any and all costs, claims, damages, or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Awards

GENERAL

HHCN reserves the sole right to amend or alter the terms and conditions of the Awards at anytime. By entering the Awards, nominee agrees to abide and be bound by these Official Rules and the decisions of HHCN, which shall be final in all matters pertaining to this Awards program. All entries become the property of HHCN and will not be returned. Void outside of the fifty (50) United States/District of Columbia and wherever prohibited or restricted by law. All federal, state and local laws and regulations apply.
